TKA Inspection Services Inspection Agreement
TKA Inspection Services agrees to conduct an inspection for the purpose of informing the client of noticeable major deficiencies in the condition of the property. The inspection and report are performed and prepared for the sole, confidential and exclusive use and possession of the contracting client. The written report will only include the following:
● Structural condition and basement(if pertinent)
● Electrical, plumbing, water heater, heating and cooling
● Current functionality, quality and condition of major systems
● Current functionality and presence of Kitchen appliances
● Presence of Low Voltage Systems
● General interior, including ceilings, walls, windows, insulation and ventilation
● General exterior, including roof, gutter, chimney, drainage, grading
It is understood and agreed that this inspection will be of readily accessible areas of the building and is limited to visual observations of apparent conditions existing only at the time of the inspection. Latent and concealed defects may or may not be determined, but our inspection will attempt to be as exhaustive as possible under any limitations we may have. It is understood that if utilities are not active, specific items may have limited verification. It is understood that although we may use a ladder in inspections, TKA Inspection services is not responsible for inspecting areas that require a ladder, particularly if deemed dangerous. TKA inspection services will not go on a clients roof for any reason, including but not limited to HVAC equipment being located on roof.
Maintenance and other items may be discussed, but they are not a part of our inspection. The report is not a compliance inspection or certification for past or present governmental codes or regulations of any kind.
The inspection and report do not address and are not intended to address the possible presence of or danger from any potentially harmful substance and environmental hazards, including but not limited to radon gas, lead paint, asbestos, mold, mildew, urea formaldehyde, toxic or flammable chemicals, and water and airborne hazards. Clients may choose to request a Radon test, in which the test will be limited to the areas tested, based on suggested testing areas by radon testing lab. Test Results will be based on our partnered testing lab and false test reports are of no responsibility of TKA Inspection Services. While we may do a visual verification, also excluded are requirements for inspections of and reports on swimming pools, wells, septic systems, security systems, central vacuum systems, water softeners, sprinkler systems, fire and safety equipment, and the presence or absence of rodents, termites and other insects. Client may request a visual inspection of Pool materials for obvious issues and may request verification of current pool equipment functionality. This inspector is not qualified to detect the presence of Chinese Drywall. Accordingly the issue of Chinese Drywall (and its potential problems) is beyond the scope of the inspection report.
The parties agree that TKA Inspection Services, and its agents and employees, assume no liability or responsibility for the cost of repairing or replacing any unreported defect or deficiency, either current or arising in the future, or for any property damage, consequential damage or bodily injury of any nature. THE INSPECTION AND REPORT ARE NOT INTENDED OR TO BE USED AS A GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, REGARDING THE ADEQUACY, PERFORMANCE OR CONDITION OF ANY INSPECTED STUCTURE, ITEM OR SYSTEM. CALIFORNIA HOME INSPECTIONS IS NOT AN INSURER OF ANY INSPECTED CONDITIONS.
The Client and TKA Inspection Services agree that should a court of competent jurisdiction determine and declare that any portion of this Agreement is void, voidable or unenforceable, the remaining provisions and portions shall remain in full force and effect. "Any dispute, controversy, interpretation or claim including claims for, but not limited to, breach of contract, any form of negligence, fraud or misrepresentation arising out of, from or related to, this contract or arising out of, from or related to the inspection or inspection report shall be submitted to final and binding arbitration under the Rules and Procedures of the Expedited Arbitration of Home Inspection Disputes of Construction Arbitration Services, Inc. The decision of the Arbitrator appointed there under shall be final and binding and judgment on the Award may be entered in any Court of competent jurisdiction."
